St Agnes Holiday Park Terms & Conditions

By booking with St Agnes Holiday Park you agree to follow these terms and conditions

We are A Keen Leisure Ltd (“we”, “our”, “us”) of St Agnes Holiday Park, Blackwater, Truro TR4 8HS.  The expression “you”, “your” means the guest and the guests’ visitors.

Please read all the conditions listed below before booking.  If you have any enquiries, please contact us by telephone on 01872 560667 or email us at [email protected]. By booking with us, you confirm that you agree to comply with and accept these booking conditions and any other written information we bring to your attention prior to confirming your booking.

Wi-fi is a facility provided free of charge throughout the park.  Its provision is subject to availability and network conditions.  It may not be available 24 hours a day and is provided for pleasure, not for business purposes.

 

BOOKING AND PAYMENTS

A booking is accepted once you receive confirmation from St Agnes Holiday Park.  It is your responsibility to check that details on your booking confirmation are correct and to notify us immediately of any discrepancies.  We cannot accept responsibility for any errors not corrected prior to arrival. If you have any specific requirements, you must contact us to check we can comply with them before arrival.

Holidays at St Agnes Holiday Park are designed for families and couples who enjoy peace and quiet and we reserve the right not to accept bookings from all male/ all-female groups or mixed young parties.  We reserve the right to refuse or terminate any booking at any time without refund or compensation when a guest contravenes these Terms and Conditions or where unreasonable, anti-social behaviour or damage to property caused by any member of the party which impairs the enjoyment or comfort of other guests.

The lead party member is the lead person named on the customer account under which the booking is made and accepts ultimate responsibility for the booking including behaviour of all party members and payments.  Accordingly, the lead party member must be present for the duration of the entire stay unless by prior arrangement with management.  They must certify when completing or confirming the booking that they are over 21 years of age and that the party will not exceed the numbers stated at time of booking. Valid photo ID may be requested on arrival.

The use of accommodation/touring pitch for the purposes of a hen/stag party is not permitted.

The lead party member is responsible for making all payments to us.  A deposit of 25% of the balance is required on booking and is non-refundable in the event of cancellation.  The balance must be paid 10 weeks prior to arrival.  Non-payment may lead to cancellation of booking.  Please note that we do not send reminders.

St Agnes Holiday Park caters for holidays and is a non-residential park; there is a maximum permitted holiday duration of 14 nights.

If you want to change any detail of your confirmed booking, you must notify us as soon as possible and we will do our best to arrange the changes.  An administration charge of £25.00 for each change will be charged.

 

SPECIAL OFFERS/DISCOUNTS

Only one discount or special offer can be applied per booking.  Once booked, any offers that may become available subsequently, such as last-minute offers, cannot be applied to an existing booking.

 

DAY VISITORS

Please advise Reception of all visitors you have to your holiday home/touring pitch with details of dates, names and vehicle registration.  Additional vehicles for day visitors will be charged a daily rate of £10.00 and provided with a Visitor Pass to be displayed in the vehicle.

 

CHILDREN

Children must not be left unattended or without adequate supervision in holiday homes/touring units or elsewhere. All persons under 16 years of age must be indoors before 11.00pm, unless under full supervision from a parent or guardian. Parents, or those having parental responsibility, must be responsible for the actions of their children.

Ball games are not permitted on the park.

Children under the age of 12 years must be supervised at all times in the shower block, laundry and whilst using the play equipment. Children are not allowed on the play area between dusk and 9.00am each day.

 

CANCELLATIONS

If for any reason we have to cancel your holiday, a full refund of the cost of your stay will be made.  This is limited to the price paid for the period agreed and does not include any consequential costs.  Alternative accommodation may be available and will be offered if possible.

If after paying your deposit and before paying the balance you decide to cancel your holiday, the deposit is not refundable.  We strongly recommend you arrange independent holiday insurance cover.  Should you cancel your holiday after making part or full payment, confirmation in writing is required and the following will apply:

  • Cancellations made more than 70 days before arrival date – 100% refund of holiday balance after deposit.
  • Cancellations made 42 to 70 days before arrival date – 50% refund of holiday balance after deposit.
  • Cancellations made 14 to 41 days before arrival date – 25% refund of holiday balance after deposit.
  • Cancellations made less than 14 days before your arrival date – No refund will be made.

 

CANCELLATIONS DUE TO GOVERNMENT PUBLIC HEALTH MEASURES

If you have to cancel your booking because UK Government Public Health measures mean it is unlawful to travel to or to make use of the accommodation/pitch you booked, you may choose to:

  • Transfer your booking to a later date free of administration charges, subject to availability – you will have to pay any difference in price if the cost of the new booking is higher or be reimbursed the difference if the cost of the new booking is lower.
  • Request a voucher with a redemption value equal to the amount previously paid by you for the booking – the voucher terms and conditions will be available before you make your choice under this clause.
  • Obtain a refund of the amount already paid by you for the booking.

EVENTS BEYOND OUR CONTROL

Except where otherwise expressly stated in these Booking Conditions we will not be liable or pay you compensation, if our

obligations to you are affected by ‘Events Beyond Our Control’.  For the purposes of these Booking Conditions, Events Beyond Our Control means any event beyond our control, the consequences of which could not have been avoided even if all reasonable measures have been taken.  Examples include warfare and acts of terrorism (and threat thereof), civil strife, significant risks to human health such as the outbreak of serious disease at the travel destination (including epidemics and pandemics)or natural disasters such as floods, earthquakes or weather conditions which prevent you from travelling to the travel destination and/or make it impossible to travel safely to the travel destination or remain at the travel destination, the act of any government or other national or local authority including port or river authorities, industrial dispute, labour strikes, lock closure, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transport and all similar events outside our control.

 

LIABILITY

Neither A Keen Leisure Ltd, nor any other person or individual company involved in operating or managing the park, nor any associated or subsidiary company, shall be liable for any personal injury, loss or damage (direct or indirect), loss of or damage to any property, including motor vehicles, motorcycles or the like, however caused, sustained by or occasioned to any person on park (including persons under the age of 18 years), whether resulting from or caused by the negligence, default, wilful act, omission or otherwise of A Keen Leisure Ltd, the individual companies or persons operating or managing the park, their employees, servants, agents, or concessionaires, or of guests, occupiers or invitees.

A Keen Leisure Ltd shall not be liable in the event of any accommodation or other facilities being unavailable due to circumstances beyond our control.  We reserve the right to close or alter the opening/closing times of any facility on site and to undertake all necessary maintenance or modifications to buildings and park grounds without prior notice.

 

SMOKING

Smoking (including E-cigarettes) is not permitted in any of our accommodation or public areas.  No charcoal, candles or any naked flames in holiday caravans.

 

VEHICLES

One vehicle is permitted per booking which can be parked next to the holiday home/on pitch.  One additional vehicle can be added to the booking at an additional charge and parking for this will be allocated on arrival.

Vehicles must not exceed the maximum speed limit on the park of 5 mph and must be driven by holders of a current driving licence with adequate third party insurance. Driving or parking on any communal grass area is prohibited.  All vehicles are parked at the owners’ risk.  All roads within the park are subject to the Road Traffic Act.

Vehicles are driven and parked on the park at your own risk.  We do not accept liability for any accidents or damage of loss incurred.

Commercial vehicles are NOT permitted on site under any circumstances.

 

Electric/Hybrid Vehicle Charging

Charging an electric or hybrid vehicle from an electric outlet in your holiday home is not permitted.  We offer a charging point for those with Electric/Hybrid cars, guidelines for using this are available in the holiday home.

 

DELIVERIES

Any supermarket or shopping delivery drivers must be able to contact the guest directly as we cannot take in any shopping on a guest’s behalf.  For all guest’s privacy we are unable to direct drivers to an accommodation/pitch.  We ask all guests to arrange to meet their driver at the barrier to collect the delivery or direct the driver to their accommodation/pitch.  No deliveries should be scheduled before your arrival.

 

BBQs

No open fires are permitted.  Purpose-made BBQs are allowed (not permitted on any decking or grass areas) but must be kept off the ground – blocks can be provided.

PERSONAL POSSESSIONS

You are responsible for your personal possessions while on the park and we are not liable for any loss or damage to these.

 

HEALTH & SAFETY

Gazebos, pup tents, fire pits and camp fires are not allowed on site.

Motorised scooters, segways, quad bikes, hover boards etc must not be used on the park.

Dangerous items including knives, firearms, air weapons, archery equipment and fireworks (including sparklers), drones, Chinese lanterns, and kites are not permitted on the park.

Whilst every care is taken to ensure the information with regards to the individual caravans and park is correct on our website and brochure, photographs are intended for guidance only.

No refunds can be given if guests depart prior to the end of the booked holiday, unless they do so as the result of the breach of some obligation on our part which would justify cancelling the holiday.

Please inform us of any problems that occur during your stay as we regret that we are unable to deal with any complaints once you have left the park.

 

 

HOLIDAY HOMES BOOKINGS

 

ARRIVAL AND DEPARTURE

Holiday homes will normally be available from 3.30pm.  If you anticipate arriving after 5.30pm, please let us know to arrange key collection.  Unless you notify us, we will assume that if your caravan is unclaimed by noon the day following the start date, the booking will be treated as cancelled.

All holiday homes must be vacated by 9.30am.  Guests undertake to leave the holiday home and all utensils in a clean and tidy condition.  In extreme cases of untidiness a cleaning charge will be applied.  You are responsible for and agree to reimburse the park owner as result of any breakage or damage in or to the caravan which is caused by you or any members of your party or any other persons invited into the caravan by you.  All damages and breakages must be reported to reception as soon as possible.

SECURITY DEPOSITS

A £100.00 pre-authorisation deposit will be taken for all holiday homes.  This acts as a deposit for your accommodation.  It is not deposited out of your account; it is held for 10 working days from the moment we swipe your card.  This covers non-accidental damage which may be made to the holiday home.  If there is no damage, loss or excess cleaning required after your departure the deposit is automatically unfrozen and made available in your account.

You must notify us of any defects with your holiday home immediately so remedial action can be taken, if appropriate.

One door key and access fob are issued on arrival per holiday home booking. Loss or damage to key/fob is chargeable.

The holiday home is offered for the sole purpose of holiday letting and must never be occupied as your principal home.  Accordingly, you agree and accept that you are not offered any rights to the accommodation other than the right to occupy the accommodation as holiday accommodation for the period of your booking.

BEHAVIOUR

You and all members of your party agree:

  • To keep the accommodation clean and tidy
  • To leave the accommodation a similar condition as you found it when you arrived
  • To behave in a way at all times while at the accommodation which does not break any law
  • Not to use the accommodation for any illegal or commercial purpose
  • Not to sublet the accommodation or any park thereof or otherwise allow anyone to stay in it who we have not previously accepted as a member of your party
  • Not to behave in an anti-social manner, breach the peace or otherwise act in a way which may disrupt or affect the enjoyment of others.

St Agnes Holiday Park can refuse to hand over the accommodation of the unreasonable behaviour of anyone in your party (including anyone invited into the accommodation by you) is likely to cause offence to other guests or members of staff, or if the Park has reasonable cause to believe you or any member of your party will cause damage or loss to the accommodation, its services or facilities.  If this happens, the contract between you and the Park will end and you will not receive any refund and we will not have any further responsibility to you.

St Agnes Holiday Park can end a stay after the keys have been handed over, if the unreasonable behaviour of anyone in your party (including anyone invited into the accommodation by you) if likely to spoil the enjoyment, comfort or health of other guests or members of staff or where you or any member of your party  (or anyone invited into the accommodation by you) has broken  or is likely to break any of these booking conditions.  If this happens, you will have to leave the accommodation immediately and no refund will be given.  You may also be responsible for any costs the Park incurs as a result of your behaviour.

There is a zero tolerance policy to rude, abusive or any other inappropriate behaviour to any member of staff/management.

 

MAXIMUM OCCUPANCY

You must not allow more people than the website states to stay overnight in the accommodation.  You cannot arrange for visitors to come to the accommodation without the advance consent from the Park. You must not hold events (such as parties, celebrations or meetings) at the accommodation without the advance consent from the Park.  If you do any of these things, the Park can refuse to hand over the accommodation to you or can repossess it.  If this occurs, this will be treated as you cancelling the booking.  In these situations, you will not receive a refund of any money you have paid for your booking. St Agnes Holiday Park will not be legally responsible to you as a result of this situation (for example, for any costs or expenses you have to pay due to not being able to stay in the accommodation, such as the cost of finding alternative accommodation).  We are under no obligation to find any alternative accommodation for you.

 

DOGS

Dogs are welcome in our pet friendly caravans (2 dogs maximum) and should be added to your party at the point of booking.  We recommend that all dogs should have insurance which includes sufficient pet liability cover and you are wholly responsible for the supervision and behaviour of your dog at all times.

Dogs are not allowed in bedrooms or on furniture.  You must not leave any dogs unattended in the accommodation, including on decking’s and gardens, or in vehicles.  Dogs must be kept on a short lead on the park, except in the Dog Exercise area, and owners are responsible for cleaning up after their dogs.

Children must not be left alone with any dog.

We do not accept dogs listed under the Dangerous Dogs Act which are: Pit Bull Terrier, Dogo Argentino, Fila Brasileiro and Japanese Tosa.

N.B. If you have a very small dog, please be aware that the gap between the balustrades on your decking can be up to 10cms.

Assistance Dogs:

It is a legal requirement that assistance dogs are entitled to occupy ANY accommodation that we provide. For this reason, we cannot therefore guarantee that any of our accommodation has NEVER had a dog staying in it.

 

DAMAGE

You are responsible for all guests staying at the accommodation and the things they do (and do not do) even if you are not at the accommodation at the time. You are responsible for and agree to reimburse the Park all costs incurred by the Park as a result of any breakage or damage in or to the accommodation which is caused by you or any members of your party or any other persons invited into the accommodation by you.  The Park can ask for an extra payment from you to cover such costs.

The Park expects the accommodation to be left in a reasonably clean and tidy state on departure.  If, in the Park’s opinion, additional cleaning is required, you will be liable to the Park for the cost of this cleaning.

You will be asked to check and sign an inventory of the accommodation and its contents on arrival.

RIGHT OF ENTRY

The Park Owners or their representative are allowed to enter the accommodation (without letting you know first if this is not practical or possible) if special circumstances or emergencies happen (for example if repairs need to be carried out) or if you break any of these terms and conditions.  You agree to allow workmen/contractors access to the accommodation as required by this clause.

HOT TUBS

For the accommodation which includes a Hot Tub, we appreciate your understanding and patience as we cannot guarantee that your Hot tub will be at its optimal operating temperature of 38°C immediately after you have checked in to your accommodation. This is due to the fact that prior to your arrival, your Hot Tub will have been completely emptied, cleaned, and refilled to maintain the required standards of cleanliness. Re-heating the volumes of water involved takes time.

You must ensure you read and comply with the rules for the safety of your party.

 

TOURING BOOKINGS

All pitches must be vacated by 10.30am.  Guests undertake to leave the pitch in a clean and tidy condition.

One access fob is issued on arrival per touring pitch booking. Loss or damage to the fob is chargeable.

You and all members of your party agree:

  • To keep the pitch clean and tidy
  • To leave the pitch a similar condition as you found it when you arrived.
  • To behave in a way at all times which does not break any law.
  • Not to use the pitch for any illegal or commercial purpose
  • Not to behave in an anti-social manner, breach the peace or otherwise act in a way which may disrupt or affect the enjoyment of others.
